General Terms and Conditions of Beyond and Beneath Tours GbR

1. Scope of Application
These General Terms and Conditions (hereinafter referred to as T&C) apply to all contracts between Beyond and Beneath Tours GbR (Baltkalne and Bull) (hereinafter referred to as Beyond and Beneath Tours) and our contractual partners (hereinafter referred to as customer or participant).
2. Formation of the Contract
The contract between Beyond and Beneath Tours and the customer is concluded by the purchase of a ticket.
Our ticketing partner is FareHarbor B.V.. Tickets are paid for via FareHarbor B.V.. In addition to these General Terms and Conditions, the General Terms and Conditions of FareHarbor B.V. shall apply, which are available on the website https://fareharbor.com/ at any time.
3. Cancellation by Beyond and Beneath Tours
Beyond and Beneath Tours has the right to withdraw from the contract and cancel the event, e.g., in the event of force majeure, illness or special circumstances on site. If an event has to be cancelled, the ticket prices already paid will be refunded by our ticketing partner FareHarbor B.V..
4. Rebooking or Cancellation by the Customer
a) For public tours, rebooking is possible up to 7 days before the booked event. Cancellation of the booked event is possible in special cases (e.g., death, illness). In the event of non-attendance, no refund will be made.
b) For private tours, rebooking is generally possible up to 48 hours before the event date, subject to the availability of Beyond and Beneath Tours’ guides.
If the booking is cancelled up to 7 days before the event, 100% of the ticket price will be refunded.
If the booking is cancelled within 7 days to 2 days before the event, 50% of the ticket price will be refunded.
If the booking is cancelled within 48 hours of the event, the ticket price already paid will not be refunded. In the event of non-attendance, no refund will be made.
5. Changes to the programme
We reserve the right to change the programme and the tours offered.
6. Disclaimer
Participation in a Beyond and Beneath Tours tour is at the participant’s own risk. Parents are liable for their children.
Beyond and Beneath Tours accepts no liability for accidents.
Excluded from this exclusion of liability are damages which are based on a grossly negligent breach of duty by Beyond and Beneath Tours.
7. Exclusion of Participants
Participants agree to treat any historical sites and monuments visited during the tour with care and to follow the instructions of the guide. Participants who permanently disrupt the course of the tour, endanger themselves or other persons, or make anti-constitutional statements may be excluded from further participation. The ticket price paid will not be refunded.
8. Dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which can be found here:

Consumers have the possibility to use this platform for the settlement of their disputes.
8. Storage/accessibility of the text of the contract (T&Cs)
Participants can download, save and print these T&Cs at any time.
9. Changes
Beyond and Beneath Tours reserves the right to change the offer and the terms of use at any time without giving reasons. Changes will be announced in a timely manner and truthfully, by appropriate means.
10. Severability clause
Should any provision of these T&Cs be invalid or violate applicable German law, it shall be replaced by a valid or enforceable provision that comes closest to the legal intent of the invalid provision.
